The Property Register & Title Deeds

How ownership becomes real in Dubai — the Property Register, its absolute evidentiary value, the rule that unregistered deals are void, and the title deed itself, under Law No. 7 of 2006.

The Property Register & Title Deeds

Ownership in Dubai is not created by a signed contract — it is created by an entry in the Property Register. This is the single most important idea in the whole legal backbone, and Law No. 7 of 2006 Concerning Real Property Registration is where it lives. Master this chapter and half the exam’s “is the deal valid?” questions answer themselves.

Definition — The Property Register

The Property Register is the record — kept in written or electronic form by the Land Department — in which the description, location and rights of every real property are stated (Law No. 7 of 2006, Art. 2). It is the official, central source of truth for who owns what in Dubai.

DLD is the only body that can register title

Article 6 is blunt: the Department is the only entity authorised to register real property rights and the long-term leasehold contracts allowed under Article 4. To do that job it also sets survey rules, prepares contract templates, keeps the real estate brokers register, sets valuation and auction rules, and fixes fees. No private registry, no developer’s internal ledger, and no notarised side-agreement can substitute for the DLD register.

The register’s superpower — absolute evidentiary value

Article 7: the Property Register has absolute evidentiary value against all parties, and its data may not be challenged unless it is proven to be the result of fraud or forgery. This is the indefeasibility of title principle. If the register says you own it, you own it — and the only way to attack that entry is to prove fraud or forgery. Article 8 gives electronically recorded documents the same evidentiary value as the originals.

This is what makes buyers confident enough to wire millions into a Dubai property: a clean title deed backed by an unchallengeable register.

The golden rule — no registration, no transfer

Article 9 states that all transactions that create, transfer, amend or extinguish real property rights must be recorded in the Property Register — and are not valid unless recorded. A sale that is signed but never registered simply does not transfer ownership.

Definition — Real Property & Real Property Unit

Real Property is anything fixed that cannot be moved without damage or alteration to its structure. A Real Property Unit is a land plot in a single real property area, including its buildings and anything attached, with no part separated by other property and no part subject to different rights than the whole (Law No. 7 of 2006, Art. 2).

Title deeds

The Department issues title deeds based on the register data (Art. 22), and those title deeds — like the register itself — have absolute evidentiary value in verifying ownership (Art. 24). Any conditions, undertakings or restrictions on the property are stated in the unit’s record. A crucial detail for apartment buildings:

Article 23: apartment buildings and multi-storey buildings are treated as a single Real Property Unit with one record, supplemented by records naming the owners of the apartments, floors and common areas.

That single sentence is the doorway to jointly owned property and owners associations (Part V) — the building is one unit on the register, subdivided into individually owned units.

Fixing and changing the register

Three lines to carry into the exam: (1) ownership passes only on registration — an unregistered sale is not valid (Art. 9). (2) The register and the title deed have absolute evidentiary value, defeasible only by fraud or forgery (Arts. 7, 24). (3) DLD is the sole registrar (Art. 6).
